EVC Telescope Mobile Application Privacy Policy
Definitions
Service provider: The legal entity operating EVC Telescope Services, which processes personal data solely on behalf of and under the documented instructions of the Consumer for the purpose of delivering assignment data as defined by the Consumer.
Consumer: The legal entity that determines the purposes and means of processing assignment data and acts as the Data Controller with respect to personal data processed through EVC Telescope Services.
Agent: An individual authorized by the Consumer to execute assignments defined by the Consumer through the EVC Telescope Mobile Application and acting under the authority of the Consumer in the course of such assignments.
Service contract: The binding agreement between the Service Provider and the Consumer that defines the scope of services and includes the documented instructions of the Consumer regarding the processing of personal data, including role allocation, retention, security, and data subject rights handling.
Data collection: The execution of assignments defined by the Consumer, whereby an Agent authorized by the Consumer submits assignment data through EVC Telescope Services, and such data is processed by the Service Provider solely on behalf of and under the documented instructions of the Consumer.
EVC Telescope Services: The technical platform operated by the Service Provider that enables the execution of assignments defined by the Consumer and processes assignment data on behalf of the Consumer in accordance with documented instructions. Such processing is necessary for the performance of the contractual relationship and for ensuring the integrity and security of the Platform.
Assignment data: Any data, including personal data where applicable, generated or submitted through the execution of an assignment defined, requested, and approved by the Consumer, and processed by the Service Provider solely on behalf of the Consumer.
Data source: Any individual or entity from whom data is obtained in the course of executing an assignment defined by the Consumer. Where such data includes personal data, the Consumer, as Data Controller, is responsible for ensuring that an appropriate legal basis exists and that required information obligations toward the data subject are fulfilled.
Data Processed
The EVC Telescope Mobile Application processes two categories of data:
- Personal Data of the Agent (User Account Data)
Personal data collected for user registration and authentication purposes include:
- Name and surname
- Email address
- Telephone number
These data are transmitted to and stored on EVC Telescope Services infrastructure for the sole purposes of:
- User registration
- Authentication
- Service continuity
- Operational communication related to the service
Such communications may include service-related notifications delivered via email or SMS.
The Service Provider does not use this data for profiling, advertising, analytics beyond operational necessity, or independent commercial purposes.
Note: Certain personal data, including full name, phone, and email, are provided by the Consumer for operational purposes and are managed under the Consumer’s authority.
- Assignment Data
Assignment Data consists of information collected by the Agent through execution of assignments defined and initiated by the Consumer.
Assignment Data may include:
- Photographs
- Video recordings
- Audio recordings
- Geolocation data
- Manually entered structured data
- Timestamp metadata
Each data unit is automatically associated with a timestamp for traceability, validation, and accountability purposes.
Assignment Data is transmitted to EVC Telescope Services solely for delivery to the Consumer who originated the assignment.
The Service Provider does not use Assignment Data for independent purposes beyond:
- Secure transmission
- Temporary storage
- Delivery
- Technical integrity and system security
No independent analytical, commercial, or behavioral processing is performed by the Service Provider unless explicitly agreed in the Service Contract. The Service Provider has no ownership or rights over Assignment Data.
Device-Level Data Access
The Mobile Application may request access to:
- Camera
- Microphone
- File system (limited and user-triggered)
- Geolocation services
Such access:
- Is governed by the mobile operating system permission framework
- Requires explicit user action
- Is initiated only during assignment execution
- Is never performed covertly
- Is never activated in the background without user interaction
Temporary local files may be created during assignment execution. These are recycled or deleted during subsequent operations and are not retained beyond operational necessity.
Prior to account activation, the Agent is required to review and explicitly accept this Privacy Policy via an affirmative action. No data transmission occurs before such acceptance.
Sharing
The data items noted above can be shared with the other applications installed on agent’s device through informed user actions that is started and carried out with the user’s full initiative and clear consent within the framework of the assignment originating from the consumer. The responsibility of all possible consequences resulting from circulation, disclosure and use of data through data-sharing belongs jointly to the agent and the consumer. The EVC Telescope Mobile Application never transmits and / or submits data by using the methods transcending the assignment definitions set by the consumer.
Assignment Data may be shared through:
- Assignment-Enabled Sharing
Certain assignments defined by the Consumer may include functionalities enabling the Agent to share collected Assignment Data using the mobile operating system’s native sharing mechanisms (“Share Data” functionality).
Where such functionality is activated:
- The Consumer determines that sharing is permitted or required as part of assignment execution.
- The Agent independently selects the third-party application or recipient through the device’s operating system interface.
- The Service Provider does not predetermine, control, or restrict the specific external recipient selected by the Agent.
Transmission performed through operating system-level sharing mechanisms occurs outside the controlled infrastructure of EVC Telescope Services once the data is handed over to the selected third-party application.
The Service Provider does not access, monitor, or control the subsequent processing carried out by such third-party applications.
The Consumer remains responsible for ensuring that the assignment design complies with applicable legal requirements regarding data disclosure. The Agent is responsible for the selection of the external recipient when using device-level sharing tools.
- User-Controlled Duplication and Device-Level Disclosure
During assignment execution, certain data (including media files) may be temporarily stored on the Agent’s device as part of normal application functionality.
Depending on device configuration and operating system behavior, such data may:
- Appear in the device’s media gallery,
- Be accessible to other applications with relevant permissions,
- Be subject to device-level backup or synchronization services,
- Be copied, captured, or reproduced by the Agent (e.g., screenshots or screen recordings).
Such actions occur at the device and operating system level and are not initiated or controlled by EVC Telescope Services.
In both cases, the Service Provider does not control, monitor, or access subsequent processing. Responsibility lies with the Consumer for assignment-level sharing and with the Agent for device-level sharing.
Retention of Data
Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected, including the performance of assignments, compliance with the Service Contract, and the establishment, exercise, or defense of legal claims.
Assignment Data is retained for the period specified in the applicable Service Contract with the Consumer, taking into account operational needs and applicable statutory limitation periods. Data is retained only as long as necessary for operational, contractual, and legal purposes.
Corporate Entity records representing Agents are deactivated upon account deletion. These records may be retained for operational continuity, legal compliance, or contractual obligations, with the Consumer responsible for any updates.
Upon expiration of the retention period, personal data is deleted or anonymized, unless continued retention is required by law, subject to a legal hold, or necessary for the exercise or defense of legal claims.
Agent Account Creation
When the application is first launched, the user is required to enter a valid invitation code provided by the Consumer. To verify the user’s identity and ensure authorized access to the Platform, a one-time validation code is transmitted to the contact information associated with the invitation (such as mobile phone number, email address, or other available electronic communication channel). The user must enter this validation code to proceed.
Following successful validation, the user may provide first and last name information for display purposes within the application (such as the root screen badge).
Separately, operational personal data (name, surname, phone, email, and similar identifiers) used for assignment delivery, contact, and business records are provided by the Consumer. The Platform processes this information solely to enable identity verification, access control, account management, system security, and fraud prevention. The ownership, accuracy, and updating of these operational data remain the responsibility of the Consumer.
By creating and using an Agent account, the Agent acknowledges that personal data required for operational purposes is provided by the Consumer and managed under the Consumer’s authority.
Assignment Data
Assignment Data generated through the use of the EVC Telescope Mobile application is processed in connection with assignments performed for the Consumer. Such data is not maintained as part of the Agent’s personal profile data but is processed in accordance with the applicable Service Agreement and the retention principles described in this Policy.
Agent Account Deletion
When an Agent requests deletion of their account:
- The active running account is permanently deactivated.
- All authentication credentials and on-device data are cleared.
- The Corporate Entity representing the Agent internally will also be deactivated; the Consumer remains responsible for maintaining or updating any personal data stored in the Corporate Entity record.
- Assignment Data produced by the Agent is owned and controlled by the Consumer and may be retained or updated only under the Consumer’s authority.
Any future access requires new authorization and verification, including revalidation of the invitation code and creation of new credentials.
Note: Personal data in the account were originally provided by the Consumer and are managed under their authority.
